1. Scope
This Privacy Policy explains how Butler Franklin Bail Bonds LLC, also referred to as “Butler Franklin,” “PayBail,” “we,” “us,” or “our,” handles personal information through:
- PayBail.co and pages that link to this Policy;
- the Butler Franklin mobile application;
- the Butler Franklin Client Help Chrome extension;
- Ask PayBail and our public search features;
- callback, contact, and text-message consent forms;
- our secure bail bond intake and customer service processes.
Butler Franklin Bail Bonds LLC is licensed in Ohio. Ohio license 1705414.
This Policy does not replace a separate privacy notice provided by a court, jail, insurer, payment service, app store, or another organization that determines its own purposes for personal information.

Call before visiting for current in-person availability. If our address of record with the Ohio Department of Insurance changes, the current address of record controls and we will update this Policy.
3. Information we collect
Information you provide
Depending on how you use our services, we may collect:
- name, telephone number, email address, mailing address, and preferred contact method;
- information about a defendant, arrest, custody location, court, case, charge, booking number, bond, warrant, holder, probation, or release status;
- relationship to a defendant and indemnitor, co-signer, reference, employment, income, collateral, or underwriting information;
- government identification and documents submitted through the approved secure intake process;
- payment method, transaction, premium, collateral, receipt, and accounting information. Do not send payment-card, bank-login, or password information through a general form, AI assistant, text, or email;
- application, callback, appointment, paperwork, and customer-service communications;
- text-message consent and withdrawal records;
- privacy requests and information needed to verify and respond to them;
- feedback you choose to provide about an answer.
Information collected automatically
We may collect limited technical information needed to operate and protect the service, including:
- IP address, date and time, requested page or endpoint, browser or app type, device and operating-system information, and error or security events;
- a short-lived or random identifier used for rate limiting, abuse prevention, settings, or an AI safety identifier;
- cookie or local-storage information needed for security, form integrity, saved preferences, or service operation;
- general AI interaction topic, result, and optional feedback after you affirmatively agree to use the AI assistant.
We do not collect precise geolocation through the Butler Franklin mobile app or Chrome extension. We do not request access to contacts, photographs, microphone, camera, advertising identifier, or background location for the current app or extension.
Sources
We collect information from you, a person acting for you or a defendant, public court or jail records, law-enforcement or government sources, insurers or managing general agents, service providers acting for us, payment services, and information generated when you use our services.
4. How we use information
We use information to:
- respond to an inquiry or callback request;
- provide bail bond intake, underwriting, posting, customer service, document, payment, collateral, and status support;
- check or organize available jail, court, custody, and bond information;
- provide requested text messages after separate consent;
- keep proof of consent, opt out, authorization, transactions, and legal or regulatory records;
- operate public search and Ask PayBail;
- measure general question topics and answer quality as described below;
- prevent fraud, spam, misuse, and security incidents;
- maintain, troubleshoot, and improve the service;
- comply with law, court process, insurance requirements, and lawful government requests;
- establish, exercise, or defend legal claims.
We do not use private application, defendant, case, identification, payment, or callback information to train Ask PayBail or to improve a general-purpose AI model.
5. Ask PayBail and question learning
General questions only
Ask PayBail is an AI-assisted public information feature. It does not provide legal advice, make a bail or underwriting decision, predict a case outcome, promise approval, or guarantee release. Do not enter names, telephone numbers, email addresses, birth dates, defendant or case details, booking numbers, charges, warrants, bond amounts, payment information, government identification, or documents into Ask PayBail.
Common private formats are blocked when reasonably detectable, but automated filters cannot identify every private detail. Use Secure Intake or request a callback for private information.
AI provider
After you affirmatively enable the AI assistant, your general question is sent to Butler Franklin and OpenAI to generate an answer. The request is configured with OpenAI response storage disabled. OpenAI may still process limited data for security, abuse prevention, legal compliance, and service operation under its business and API terms. Private callback and application information is not sent to OpenAI through Ask PayBail.
On the website, we do not intentionally retain a transcript of the Ask PayBail conversation. Server and security logs may record limited technical events. The mobile app and Chrome extension use the limited learning record described below.
Limited learning record
After you agree to use the AI assistant, we retain for up to 90 days:
- a random interaction ID;
- date and time;
- channel, such as mobile app or Chrome extension;
- general topic, such as application, release timing, payment, or hours;
- outcome, such as answered, failed, or blocked;
- optional helpful or needs-work feedback.
When “Help improve answers” is off, we do not retain the question wording in the learning database. Questions without retained wording use a topic-level hash rather than a hash of the question.
When you separately turn on “Help improve answers,” we may also retain minimized, pseudonymized wording for up to 90 days. This control is off by default. Automated minimization removes common contact details, long numbers, and likely names, but the result is not described as anonymous or legally deidentified.
The app and extension return an interaction ID and provide a control to delete that learning record. You may also use Privacy Choices. We do not place an IP address, browser identity, application record, or OpenAI safety identifier in the learning database.
Butler Franklin staff may review topic counts, repeated opted-in questions, failures, and feedback to identify information gaps. Customer interactions do not automatically change production answers. A person must review and approve changes before publication.
6. Mobile application and Chrome extension
Mobile app
The mobile app provides public search, Ask PayBail, telephone links, and access to secure intake. Before the app opens the Captira-based application, it explains the categories of intake data and asks you to continue. The embedded application is restricted to approved PayBail and Captira navigation, uses an ephemeral browsing mode where supported, and has an external-browser option.
The current app does not create a Butler Franklin user account. If account creation is added, we will provide in-app and web account deletion as required by applicable app-store rules.
Chrome extension
The extension stores the AI agreement, improvement preference, and a random local identifier in Chrome storage. The identifier is used for abuse prevention, not advertising. The review build connects only to Butler Franklin’s approved production service. You can remove local extension information by uninstalling the extension or clearing its stored data.
The extension requests the Chrome storage permission. It does not read browsing history, page contents, tabs, cookies, passwords, form entries, or other websites. It does not store an OpenAI API key.
7. Text messages
Our Butler Franklin Customer Care SMS program sends only requested informational and customer-care messages. It does not enroll you in marketing texts.
Text consent is optional, separate, and not a condition of purchase or service. Supplying a telephone number for a callback, application, payment, or another purpose is not text-message consent. Review the SMS Terms and Conditions and the disclosure beside the unchecked consent box.
We do not sell, rent, buy, or share mobile telephone information or text-message opt-in data and consent with third parties or affiliates for marketing or promotional purposes. We disclose it only to providers and carriers that help deliver and administer the requested program, to prevent misuse, or when legally required. Those providers may not use it for their own marketing.
Reply STOP or use any other clear revocation request to stop. We process revocation as soon as practicable and no later than 10 business days, with an operating target of immediate suppression. We may send 1 nonpromotional confirmation.
8. Cookies, local storage, analytics, and Global Privacy Control
We use essential cookies or similar storage for security, form integrity, consent choices, and service operation. The app and extension use local storage as described above.
We do not use personal information for targeted advertising, and we do not sell or share personal information for cross-context behavioral advertising. Nonessential analytics, session replay, and advertising tags are disabled unless you affirmatively choose them through a privacy control. Declining analytics does not prevent you from using the service.
We recognize Global Privacy Control, when received, as a request to opt out of sale, sharing, and targeted advertising for the associated browser or device. Because we do not engage in those activities, we continue to keep them off. We do not respond to older “Do Not Track” signals that do not communicate a legally recognized choice, but we do respond to Global Privacy Control as described here.
The secure Captira application and services such as reCAPTCHA may use necessary technologies under their provider terms. We contractually limit service providers to authorized purposes where they act for us.
9. When we disclose information
We may disclose information to:
- hosting, security, backup, website, app, and technical support providers;
- Captira and approved intake or case-management providers;
- OpenAI for a general Ask PayBail question after your affirmative choice;
- Make, RingCentral, and communication or workflow providers for callback and customer-service routing;
- the selected messaging provider, telephone carriers, and campaign administrator for requested texts;
- insurers, managing general agents, sureties, underwriters, courts, clerks, jails, law enforcement, and government agencies when needed for the requested service or required by law;
- payment, accounting, banking, and transaction providers for authorized transactions;
- lawyers, accountants, auditors, security investigators, and other professional advisers;
- a successor in a merger, acquisition, financing, reorganization, bankruptcy, or asset transfer, subject to applicable notice and privacy obligations;
- another party at your direction or with your specific consent.
Service providers may process information only for the contracted service, our documented instructions, security, or legal compliance. We require appropriate confidentiality and security protections.
10. Sale, sharing, advertising, and profiling
We do not:
- sell personal information;
- share personal information for cross-context behavioral advertising;
- use personal information for targeted advertising;
- sell sensitive data;
- sell or use a minor’s data for targeted advertising;
- profile a person to make a decision producing legal or similarly significant effects through the website, app, extension, or Ask PayBail.
Bail bond approval and terms may involve human underwriting and legal requirements. Ask PayBail is not used to make that decision.
11. Retention
We keep information only for the shortest of the period below, the period reasonably necessary for the disclosed purpose, or a longer period required by law, court order, an insurer, a legal hold, fraud prevention, or an active dispute.

Information held by a service provider is subject to our instructions and the applicable contract. Backup copies are removed through the backup lifecycle and are not restored for ordinary use after deletion.
12. Your privacy rights
We voluntarily offer the following rights to United States residents, subject to legal exceptions:
- confirm whether we process your personal information;
- access the information and receive a portable copy;
- correct inaccurate information;
- delete information;
- obtain categories and, when reasonably available, a list of specific third parties that received your information;
- opt out of sale, sharing, targeted advertising, and qualifying profiling. We state that we do none of these;
- withdraw consent, including text consent and optional question-wording retention;
- use an authorized agent;
- appeal a denied request;
- receive equal service without discrimination for using a privacy right.

We normally respond within 45 days. We may extend once for up to 45 additional days when reasonably necessary and will explain the extension. We process opt-out and consent-withdrawal requests sooner. We verify a request in proportion to the sensitivity and risk. Do not send a Social Security number, payment information, password, or government ID unless we specifically determine a less intrusive method cannot verify a high-risk access request.
An authorized agent must provide reasonable proof of authority. We may also ask the consumer to confirm the authorization directly. To appeal, use Privacy Choices or email info@paybail.co with “Privacy Appeal” and the earlier request date. We will respond to an appeal within the period required by applicable law.
Deletion rights are subject to exceptions, including completing a requested service, security, fraud prevention, accounting, exercising legal rights, and records that Ohio law requires surety bail bond agents to retain. When we deny all or part of a request, we explain the reason unless law prohibits the explanation.
13. Security
We use administrative, technical, and physical measures designed to protect personal information. Measures include HTTPS, access controls, least privilege, authentication, restricted administrator access, software updates, backups, monitoring, input limits, and separation of general AI questions from private intake.
No system is completely secure. If you believe information was sent to the wrong place or an account or message is fraudulent, call 513 PAY BAIL using the telephone published on PayBail.co.
14. Children
Our services are directed to adults handling a bail matter and are not directed to children under 13. The text program is limited to people 18 or older. We do not knowingly collect personal information from a child under 13 through the app, extension, or Ask PayBail. If you believe a child submitted information, contact us and we will review and delete it when required.
15. Changes to this Policy
We may update this Policy to reflect service, vendor, legal, or security changes. We will change the “Last updated” date and provide additional notice when required. We will not use previously collected information for a materially different, incompatible purpose without the notice or consent required by law.
OpenAI website assistant: The Ask PayBail feature uses the OpenAI API to answer general questions. The site screens prompts for common sensitive information and sends approved prompts to OpenAI for moderation and response generation. A request may include the visitor’s prompt, fixed business instructions, limited public page context, and a pseudonymous hashed safety identifier. The assistant is configured with store: false, and Butler Franklin does not intentionally store assistant conversation transcripts.
OpenAI states that API inputs and outputs are not used to train its models by default unless the API customer expressly opts in. OpenAI may retain abuse monitoring logs for up to 30 days unless a longer period is required by law. Review OpenAI’s API data controls and business data use explanation.
Do not send names, telephone numbers, email addresses, dates of birth, defendant information, case or booking numbers, charges, warrants, bond amounts, payment details, identification documents, or other private information through the OpenAI assistant. Use the secure Captira application or call 513 PAY BAIL when private case information is needed.
