Butler Franklin Terms of Use

These Terms govern PayBail.co, the Butler Franklin mobile app, the Butler Franklin Client Help Chrome extension, Ask PayBail, and public information and intake links provided by Butler Franklin Bail Bonds LLC. By using a service, you agree to these Terms. If you do not agree, do not use that service. You may still call 513 PAY BAIL for assistance.

1. Butler Franklin information

Public pages, search results, Ask PayBail, app content, extension content, and customer-service explanations provide general bail process and Butler Franklin service information. They are not legal advice and do not create an attorney-client relationship.

Court, jail, clerk, and public-record information can be delayed, incomplete, or different across systems. Verify current case, custody, bond, holder, court, and release information with the responsible official source.

3. No guarantee

Using a website, app, extension, form, AI feature, callback request, or application does not guarantee:

Approval and terms depend on the circumstances, applicable law, court and jail procedure, underwriting, the insurer or surety, documentation, payment, collateral review when applicable, and other required information. Courts and jails control release conditions and final release processing.

4. Secure intake and third-party services

The secure application is provided through Butler Franklin’s approved Captira-based intake. The mobile app may display that application in an embedded browser after a disclosure and affirmative continue action. An external browser option is also available.

Captira, app stores, browser stores, telephone carriers, payment services, courts, jails, and other third parties may have their own terms. Butler Franklin is responsible for its own statements and handling, but it does not control an independent third party’s service availability, official records, or terms.

Do not put Social Security numbers, payment-card or bank-login information, passwords, identification images, documents, or detailed private case information in a general contact form, Ask PayBail, app search, extension search, or text message. Use the approved secure intake path when that information is required.

5. Ask PayBail

Ask PayBail uses artificial intelligence to answer general questions from approved public Butler Franklin information. It can make mistakes or misunderstand a question.

Before the mobile app or Chrome extension sends a question to OpenAI, it asks you to affirmatively enable the AI assistant. Do not use Ask PayBail for emergencies, legal advice, private facts, case-specific decisions, payment instructions, or a guarantee.

When an answer is unclear, incomplete, time-sensitive, or inconsistent with a court or jail, call 513 PAY BAIL and verify with the official source.

6. Question learning and feedback

After you agree to use the AI assistant, Butler Franklin may keep a limited interaction record for up to 90 days, including a general topic, outcome, and optional feedback. Question wording is not retained in the learning database unless you separately enable “Help improve answers.” That option is off by default and stores only minimized, pseudonymized wording for up to 90 days.

The app and extension allow deletion of the associated learning record. Customer questions and feedback do not automatically change production answers. Butler Franklin requires human review before publishing a change.

7. Text messages

Text messages require separate consent. Using the website, app, extension, callback form, or Captira application does not by itself enroll a telephone number in recurring texts.

The Butler Franklin Customer Care SMS Terms govern that program. Reply STOP or use another clear revocation request to opt out.

8. Acceptable use

You may use the services only for lawful, personal, or authorized business purposes related to Butler Franklin information or a legitimate bail matter. You may not:

9. Ownership and permitted use

Butler Franklin or its licensors own the service software, original content, branding, graphics, and compilation, except official public information and third-party materials. We grant you a limited, revocable, nonexclusive, nontransferable right to use the public service for its intended purpose.

You retain rights in information you submit. You give Butler Franklin permission to process it only as needed for the requested service, security, legal compliance, and the uses described in the Privacy Policy.

10. Availability and changes

We may maintain, update, suspend, or discontinue a feature. We try to keep urgent contact and secure intake routes available, but no online feature is guaranteed to be uninterrupted or error-free.

We may update public information as courts, jails, laws, service areas, payment methods, providers, or business facts change. The date on a policy or terms page identifies its current version.

11. Disclaimers

To the extent permitted by law, the public website, app, extension, search, and AI information features are provided “as is” and “as available.” Butler Franklin disclaims implied warranties that cannot reasonably apply to free public information features, including merchantability, fitness for a particular purpose, and noninfringement.

This section does not disclaim an obligation imposed by bail bond law, consumer-protection law, a signed bail bond agreement, or another right that cannot lawfully be waived.

12. Limitation of liability

To the extent permitted by law, Butler Franklin is not liable for an indirect, incidental, special, consequential, exemplary, or punitive loss caused solely by reliance on a free public information or AI feature, an unavailable third-party system, or delayed official record.

This limitation does not apply where prohibited, to intentional misconduct or gross negligence, to a data-security or privacy obligation that cannot be limited, or to Butler Franklin’s duties under an executed bail bond agreement.

13. Privacy

The Privacy Policy describes collection, use, disclosure, retention, security, and privacy rights. The Policy is incorporated into these Terms for the services it covers.

14. Governing law

Ohio law governs these Terms without regard to conflict-of-law rules, except where federal law or the nonwaivable law of another state applies. A dispute concerning these Terms may be brought in a court with lawful jurisdiction in Ohio unless applicable law permits or requires another forum.

These Terms do not require arbitration and do not waive a right to bring an individual claim or use a government complaint process.

15. Severability and no waiver

If a provision is unenforceable, it will be limited to the minimum extent necessary and the remaining provisions remain effective. A delay in enforcement is not a waiver.
